1. Acceptance of Terms
By accessing or using the Haja marketplace website, WhatsApp bot integration, or associated services (collectively, the "Service"), provided by Haja Technologies Ltd. ("Haja", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.
2. Service Description
Haja provides a conversational commerce platform that allows merchants to list products, create digital storefront drafts, and receive buyer inquiries directly over WhatsApp. Haja acts as a facilitator and platform provider, enabling direct communication between buyers and sellers.
3. Merchant Responsibilities & Content Policy
As a merchant or seller using Haja, you agree that:
- You own or have full rights to publish all product images, titles, descriptions, and pricing uploaded through your WhatsApp messages.
- You will provide accurate descriptions and genuine prices for all listed items.
- You will not list prohibited, counterfeit, illegal, or hazardous items.
- You are solely responsible for fulfilling buyer orders, managing shipments, and resolving payment or quality disputes directly with your customers.
Platform Role & Disclaimers
Haja does not take custody of merchant goods, execute payments, or hold escrow funds on behalf of buyers or sellers unless explicitly provided by an integrated checkout feature. All transactions take place directly between buyer and seller.
4. Subscription Tiers & Usage Limits
Haja offers free listing tiers as well as premium subscription tiers for active merchants:
- Each subscription tier includes a maximum number of product listings permitted within a billing cycle.
- When a merchant reaches their subscription limit, listing creation will pause until the subscription is renewed or upgraded.
- Fees paid for subscriptions are non-refundable except where required by law.
5. Intellectual Property
The Haja brand, software, logo, design system, website content, and underlying algorithms are the exclusive property of Haja Technologies Ltd. You retain ownership of your product photos and content uploaded to the platform, granting Haja a non-exclusive license to display and distribute your listings for marketplace discovery.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Haja Technologies Ltd. shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the service, unavailability of WhatsApp third-party messaging services, or disputes between buyers and sellers.
7. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.
